Terms of Service
These Terms of Service (the "Terms") govern access to and use of AskMaud (the "Service"), operated by Maydream SAS ("Maydream", "we", "us"). By creating an account or using the Service, you ("User", "you") accept these Terms.
1. The Service
AskMaud is an AI-powered assistant that provides access to the AdForum Creative Library, enabling users to search, analyze, and aggregate advertising campaign information through natural language queries. The Service is intended primarily for professional use (agencies, brands, researchers, individuals working in advertising and marketing).
2. Account
Access to the Service requires authentication through LinkedIn Sign-In. You are responsible for the accuracy of the information provided and for all activity under your account. You must be at least 16 years old to use the Service.
3. Subscription Plans and Pricing
The Service offers the following plans, with prices in euros (EUR), including applicable VAT:
- Free — €0. Limited daily usage, watermarked reports.
- Basic — €99 / month. Standard limits for individual professional use.
- Pro — €299 / month. High usage limits for power users.
- Custom — quote on request. Agencies and large organizations.
Current pricing and plan details are published at /plans. Maydream may modify plans and pricing; changes apply from the next billing cycle and are communicated in advance.
4. Billing and Payment
Paid subscriptions are purchased and billed monthly in advance through AdForum (www.adforum.com), Maydream's commerce platform, which uses Stripe as payment processor. Subscriptions renew automatically until cancelled. You can cancel at any time from your AdForum account; cancellation takes effect at the end of the current paid period. No refund is granted for partial periods, except where required by law.
5. Right of Withdrawal (Consumers)
If you subscribe as a consumer, you have a 14-day right of withdrawal under French law. However, by starting to use the Service before the end of this period, you expressly waive your right of withdrawal for services already rendered (Art. L.221-28 Consumer Code).
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of third-party rights;
- Attempt to reverse-engineer, scrape, or bulk-extract content from the Service;
- Resell or redistribute the Service or AdForum Creative Library content;
- Use the Service to generate defamatory, infringing, or harmful content;
- Circumvent usage limits, access controls, or security features;
- Use automated means (bots, scripts) beyond what the Service explicitly permits.
We may suspend or terminate accounts that violate these rules.
7. Intellectual Property
The Service, its code, design, and all underlying content (including the AdForum Creative Library) are the property of Maydream SAS or its licensors. No rights are transferred to you beyond the limited, personal, non-exclusive, non-transferable right to use the Service under these Terms.
You retain ownership of the prompts you submit. You grant Maydream a worldwide, royalty-free license to process them solely to operate and improve the Service. AI-generated outputs are provided "as is"; you are responsible for reviewing and using them.
8. AI-Generated Content — Accuracy Disclaimer
The Service uses large language models that may produce inaccurate, incomplete, or outdated information ("hallucinations"). Outputs do not constitute professional advice. You must independently verify any information before relying on it for business decisions.
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance, updates, or outages of third-party providers (OpenAI, Google Cloud, AdForum, LinkedIn) may temporarily affect availability.
10. Limitation of Liability
To the fullest extent permitted by law, Maydream's aggregate liability for any claim arising out of or related to the Service is limited to the amounts paid by you for the Service during the 12 months preceding the claim. We are not liable for indirect damages, loss of profits, loss of data, or business interruption. Nothing in these Terms limits liability for gross negligence, willful misconduct, or liability that cannot be excluded under French law.
11. Termination
You may close your account at any time. We may suspend or terminate your access for material breach of these Terms, with reasonable notice except in cases of serious breach. Upon termination, your right to use the Service ends; provisions that by their nature survive termination (IP, liability, governing law) remain in force.
12. Changes to the Terms
We may update these Terms. Material changes will be communicated in-app or by notice at least 15 days before they take effect. Continued use after that date constitutes acceptance.
13. Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France, subject to mandatory rules of consumer protection that may grant consumers the right to bring an action before the courts of their place of residence.
In accordance with Article L.616-1 of the French Consumer Code, consumers may also resort to the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.
